DL INTERIORDESIGN reserves the right to modify the policy of use of this agreement on its own initiative and without prior notice to the User, where such terms and conditions shall enter into force from the moment they are published on the website. In any case, the aforementioned modifications shall not have retroactive effects on the services previously contracted by the User. SCOPE:

These provisions are intended to regulate the sale of products offered by DL INTERIORDESIGN company operating on the Internet through the website www.dl-interiordesign.es

DL INTERIORDESIGN is a company dedicated to the sale of furniture, small household items and decoration.

All the sections that make up these Terms and Conditions of Use must be known and accepted by all users who access the website and shop through it.

INTELLECTUAL PROPERTY:

With regard to intellectual property, reference should be made to the provisions of the Legal Notice on the www.dl-interiordesign.es website. However, it should be noted that the public information contained on the website, software, products or services you can obtain from them, as well as trademarks, products and logos, among others, of companies and centers of the services offered are protected by the laws on intellectual property, so it does not authorize the copying, transmission, transfer, disposal or use by the user without prior express consent of DL INTERIORDESIGN of the owner of the trademarks or logos, under the terms provided in the Spanish Law on Intellectual Property.

USE OF THE PORTAL:

The User agrees to use the Portal, its contents and services offered in accordance with the Law, these Terms and Conditions of Use, good customs and public order. When using this website you may not:

DL INTERIORDESIGN will use all the means at its disposal to keep the service available 24 hours a day, committing itself in case of failure to carry out, as soon as it becomes aware, any repairs necessary for the re-establishment of the service. However, if the lack of service is due to causes beyond DL INTERIORDESIGN’s control such as prolonged interruption of any external supply, crashes of the main nodes of the network, social conflicts, actions of third parties, or the temporary suspension of the service due to the need to update the equipment, DL INTERIORDESIGN cannot guarantee the re-establishment of the service in an efficient way, where it disclaims liability for any damages that arise from the lack of service.

LIABILITY:

DL INTERIORDESIGN shall be liable only and exclusively for the services it provides itself and for the contents directly originated by DL INTERIORDESIGN or identified with its Copyright. Such liability is excluded in cases of force majeure or in cases where the configuration of the user’s equipment is not adequate to allow the proper use of the Services offered by DL INTERIORDESIGN.

DL INTERIORDESIGN is not liable for the appearance of ads indexed in search engines outside the Portal once they have been removed from our databases. You accept full liability for the legality of your actions under the laws that apply to you, as well as for the legality of the items that you advertise on our website.

MINORS:

In general, in order to use the Portal Services, minors under the age of 14 must have previously obtained the authorization of their parents, guardians or legal representatives, who will be liable for all acts carried out through the Portal by minors for which they are responsible. 

TERMS AND CONDITIONS OF SALE

PLACING AN ORDER

To purchase our products, you must log in or register as a user of our website.

To register as a user, DL INTERIORDESIGN will collect a series of data from you that are necessary to process the purchase of the products selected by you. If you do not provide them, you will not be able to purchase online.

When you register, you will be given a username and a password with which you can log in to make any online purchases you wish. In accordance with the provisions of the General Data Protection Regulation (EU) and Spanish Organic Law 3/2018 on Data Protection and Guarantees of Digital Rights, DL INTERIORDESIGN informs users that the personal data collected during the purchase process will be added to a file under its responsibility in order to process such actions by the user and manage subsequent actions arising from them. Unless you inform us otherwise, we will assume that your data have not been modified, that you undertake to notify us of any variation and that we have the consent to use them in order to enhance the relationship between the parties. The user must provide a valid email address during the purchasing process.

At the moment of the formalization of the order through the website www.dl-interiordesign.es it is understood that the user has given consent for the validity and effectiveness of the sales contract that is binding upon the parties. DL INTERIORDESIGN will electronically store the order data.

The customer will receive a copy of the order upon receiving the product at the provided delivery address. They will also receive an invoice for the order by email.

ORDER CONFIRMATION AND ACCEPTANCE

Once you have chosen the products you want to buy, you will have to go to the section called “Cart” or “Buy now”, where you will find a summary of the products chosen. Then you must follow the steps indicated on the website by accessing “complete purchase” and fill in the purchase data.

Afterwards, you must accept the order with payment obligation by clicking on the “Checkout” button and the confirmation will be sent to you by email.

The contract between the User and DL INTERIORDESIGN will be considered to have concluded once DL INTERIORDESIGN sends confirmation of the purchase to the e-mail address provided by the customer, which will be confirmed within a maximum of 24 hours.

PRICE

The products offered by DL INTERIORDESIGN are sold at the price shown on the website at the time of registration of the order by the user. Prices are stated in euros and include Value Added Tax (VAT). DL INTERIORDESIGN reserves at all times and unilaterally the right to change the price of products and services offered through www.dl-interiordesign.es. To provide the customer with certainty and security in the price of their products, the price will be that which is in force in the advertising when formalizing the order.

DELIVERY TIMES

Once the product is in stock and the order is approved by DL INTERIORDESIGN, it will have a minimum shipping time of 24 hours to a maximum of 14 calendar days.

Delivery times are indicative. These deadlines will be met provided that the customer has provided the details of name and address correctly. DL INTERIORDESIGN can bring forward the delivery date of an order, whereby the customer undertakes to receive the order when such delivery occurs.

On special dates such as Christmas, Epiphany or special holidays, the delivery times indicated are not guaranteed due to the high volume of goods in transport companies. After holiday periods, shipping may be delayed due to the high volume of outstanding shipments.

PLACE AND MANNER OF DELIVERY

The delivery of the products will be made to the address designated at the time of contracting by the user. The subsequent modification of the delivery address by the client may generate additional costs over the sales price that will be at the expense of the purchaser.

Likewise, in purchases of large furniture, delivery will be made to the address established by the buyer when processing the order at street level. If the customer wishes the product to be brought up to their home, they will have to pay an additional amount. Such amount will be established in the options to be chosen when processing the order on the website.

The goods will be delivered to the client by the transport company, together with a delivery note that will state the data identifying the customer, the order and the number of products that make up the shipment. If the customer finds any errors or that the goods are visibly damaged upon receipt, they must record such facts on the delivery note of the carrier and make these facts known to DL INTERIORDESIGN within 24 hours by calling the Customer Service number at 876 645 229 or by sending an email to info@dl-interiordesign.es

The customer can also pick up the delivery at one of the locations of the NACEX transport company.

SHIPPING COSTS 

The products offered by DL INTERIORDESIGN can only be sent to addresses on the Spanish mainland, the Balearic Islands, Portugal, Ceuta and Melilla.

Shipping costs will be chosen by the customer from the following table.

  • SMALL HOUSEHOLD GOODS:
    • Spanish mainland: For orders of €150 or less, the shipping cost is €5. For orders of €151 or more, shipping costs are free of charge.
    • Portugal: For orders of €150 or less, the shipping cost is €5. For orders of €151 or more, shipping costs are free of charge.
    • Balearic Islands: For orders of €500 or less, the shipping cost is €25. For orders of €501 or more, shipping costs are free of charge.
    • Ceuta: For orders of €500 or less, the shipping cost is €25. For orders of €501 or more, shipping costs are free of charge.
    • Melilla: For orders of €500 or less, the shipping cost is €25. For orders of €501 or more, shipping costs are free of charge.
  • FURNITURE:
    • Spanish mainland: For orders of €1500 or less, the shipping cost is €89.90. For orders of €1501 or more, shipping costs are free of charge.
    • Portugal: For orders of €1500 or less, the shipping cost is €89.90. For orders of €1501 or more, shipping costs are free of charge.

If you are interested in receiving a shipment outside this area, you should contact DL INTERIORDESIGN before placing the order at its email address info@dl-interiordesign.es or through its Customer Service telephone number 876 645 229, to see if it is possible to make the shipment and, if so, calculate the cost.

METHODS OF PAYMENT

The customer may pay for the order in one of the following ways. During the purchase process you must indicate your choice:      

VISA or MASTERCARD debit or credit card:

All transactions involving the transmission of personal or banking data are carried out using a secure environment. All the information you transmit to us travels encrypted through the network. When paying by VISA or MASTERCARD you will always be asked for the following information: the card number, the expiry date, and a Validation Code that coincides with the last three digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering further assurances regarding the security of the transaction. When the amount of a purchase has been fraudulently or improperly charged by using a payment card number, the cardholder can demand the immediate cancellation of the charge. In this case, the corresponding debit and credit entries in the accounts of the supplier and the holder shall be made as soon as possible.  However, if the purchase was actually made by the cardholder and the demand for a refund is not the result of having exercised the right of withdrawal or resolution and, therefore, has improperly requested the cancellation of the corresponding charge, the customer will be obliged to compensate DL INTERIORDESIGN for damages caused as a result of such cancellation.

PRODUCT WARRANTY

All products offered on the www.dl-interiordesign.es website are covered by the commercial warranty of the supplier. For such a warranty to be valid, the product must have a factory defect and the customer must keep the receipt for the product. The warranty only covers defects of origin, i.e., it excludes deterioration of the product due to normal use, as well as breakage or wear due to improper use or handling of the product, which in any case will be the responsibility of the customer.

DL INTERIORDESIGN has an after-sales service. While the warranty is in force, the customer may enforce it by contacting DL INTERIORDESIGN through its email address info@dl-interiordesign.es or through its customer service phone 876 645 229 to report the incident in question. 

WITHDRAWAL

The buyer will have a maximum period of fourteen calendar days to withdraw from the day the customer receives the product, with no penalty and with no need to state a reason.

The exercise of the right of withdrawal must be made by notification by telephone to the Customer Service number 876 645 229, by e-mail to info@dl-interiordesign.es or by sending the letter of withdrawal provided at www.dl-interiordesign.es or to the postal address Polígono la Unión 11, Naves 4-5, C.P. 50.013 Zaragoza, Spain.

In accordance with the provisions of Article 103 of Law 3/2014 of 27 March amending the revised text of the General Law for the Defense of Consumers and Users, the following are exempt from withdrawal: supplies of services or goods made to the consumer’s specifications or clearly personalized, sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery, or which, by their nature, cannot be returned or may deteriorate or expire rapidly.

The customer must return or deliver the product directly to DL INTERIORDESIGN, and cover the cost of return, to the address located at Polígono la Unión 11, Naves 4-5, C.P. 50.013 Zaragoza, Spain, without any undue delay, and in any case within a maximum period of fourteen calendar days from the date on which the right of withdrawal from the contract is formalized. The term will be understood to be ended if the customer returns the product before the end of the term.

Products to be returned must be in perfect condition, unused and in their original packaging. To avoid problems during transport, please ensure that the package is properly protected and sealed. Once received, we will check its condition and, if everything is correct and in perfect condition, we will refund the amount paid. The customer must bear the direct cost of returning the product.

It must be made absolutely clear that no monies will be refunded in the event that the product has been damaged, is not in its original packaging or has been used.

Refunds of the monies received from the customer will be made using the same means of payment employed by the customer, unless otherwise agreed. DL INTERIORDESIGN is not obliged to refund the amount until it has received the product or until the customer has submitted proof of return of the goods, whichever condition is met first.

In case of unjustified delay by DL INTERIORDESIGN with respect to the return of the sums paid, the consumer and user may claim to be paid twice the amount due, without prejudice to their right to be compensated for damages suffered in excess of that amount.

RETURN OF DEFECTIVE OR DAMAGED PRODUCTS

In the event that the product received by the customer is not in good condition due to any defect or damage not attributable to the customer, they are entitled to return the product by informing DL INTERIORDESIGN of the reason for return, along with photographs of the damaged or deteriorated product, to the email address info@dl-interiordesign.es or at the postal address listed in the section on claims.  DL INTERIORDESIGN will assume the cost of the return and will proceed to replace the defective or damaged product with a new one. 

AGREED

These conditions of use and sale constitute the entire agreement between the parties. In the event one of the clauses of these conditions is void, this will not affect the other conditions.

APPLICABLE LAW AND JURISDICTION IN THE EVENT OF DISPUTES

The relationship between DL INTERIORDESIGN and the user shall be governed by Spanish law in force and any dispute shall be submitted to the Courts of the city of Teruel.
